About these Terms
These Terms & Conditions ("Terms") form a legally binding agreement between you ("you", "your", "User") and NilesoftAI, having its registered office at [REGISTERED_ADDRESS], India ("Emploi", "we", "us", "our"), which operates the Emploi mobile application ("App") and the website at emploi-swipejobs.com, together with any related services and features (collectively, the "Platform").
Emploi is a product of NilesoftAI (nilesoftai.com).
By downloading, installing, registering for, or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Platform.
These Terms constitute an "electronic record" within the meaning of the Information Technology Act, 2000 and applicable rules thereunder. No physical or digital signature is required; your acceptance in-app is legally binding and is recorded against the specific version of these Terms that you were shown.
Important platform disclaimer: Emploi only provides a technology platform for Seekers and Givers to discover, communicate, and make their own arrangements. Emploi is not responsible for any work offered, accepted, performed, rejected, cancelled, or paid for through or because of the Platform. All work terms, payment terms, legal compliance, safety arrangements, and disputes are solely between the relevant Seeker and Giver.
1. Definitions
- "Seeker" means a user who uses the Platform to discover and apply for jobs.
- "Giver" means a user, whether an individual or a business, who uses the Platform to post jobs and hire Seekers.
- "Content" means any text, photo, profile information, job posting, review, rating, message, or other material submitted by a user.
- "Match" means the state in which a Giver has accepted a Seeker's application (or invited a Seeker who has accepted) for a specific job.
- "Job Arrangement" means any agreement, contract, engagement, or transaction entered into between a Seeker and a Giver, whether formed on the Platform or off-Platform, arising from an interaction on the Platform.
- "Liveness Check" means the on-device front-camera selfie challenge used to establish that a live human being, and not a photograph or recording, is operating the account.
- "KYC Check" means the optional Aadhaar Secure QR scan described in Section 9, used to bind an account to a government-issued identity document.
- "Verified Badge" means either of the two distinct marks described in Section 9.4.
2. Eligibility
2.1 You must be at least 18 years of age to use the Platform. Employment-related interactions are restricted to adults under Indian law.
2.2 You must be legally capable of entering into a binding contract under the Indian Contract Act, 1872.
2.3 If you use the Platform on behalf of a business, you represent and warrant that you have the authority to bind that business to these Terms.
2.4 You must not be a person barred from receiving services under Indian law or the laws of the jurisdiction in which you reside.
2.5 The Platform is intended for use within India. Job discovery, distance calculation, phone-number formatting, and identity verification are all built around Indian usage.
2.6 If we discover that you do not meet these eligibility requirements, we may suspend or terminate your account without notice.
3. Nature of the Platform
3.1 Emploi is an intermediary within the meaning of Section 2(1)(w) of the Information Technology Act, 2000. The Platform is a neutral technology marketplace that connects Seekers and Givers.
3.2 Emploi is not a party to any Job Arrangement. We do not employ Seekers; we do not hire on behalf of Givers; we are not a staffing agency, labour contractor, recruiter, payroll provider, or employment agency; and we do not guarantee that any job will be posted, filled, performed, completed, lawful, safe, or paid.
3.3 Emploi does not process payments. All payment terms (amount, timing, method, taxes, receipts) are agreed and settled directly between Seeker and Giver, off-Platform. We do not hold funds in escrow and are not responsible for any non-payment, underpayment, dispute, refund, tax compliance, or chargeback.
3.4 Limits of verification. The Liveness Check and KYC Check described in Section 9 are the only checks we perform. Except for those checks, and strictly within their stated limits, Emploi does not verify the qualifications, skills, experience, background, criminal history, employment history, or right-to-work of Seekers, nor the legitimacy, solvency, licensing, or regulatory compliance of Givers. A Verified Badge is not a character reference, a background check, a police clearance, or a guarantee of competence, honesty, or safety. Users remain solely responsible for their own due diligence.
3.5 Content on the Platform is user-generated. While we may remove Content that violates these Terms, we do not pre-moderate Content and do not endorse, adopt, or guarantee the accuracy of any Content.
3.6 No control over work or users. Emploi does not supervise, direct, control, manage, inspect, or monitor any Seeker, Giver, workplace, worksite, job performance, payment, or offline interaction. Any employment, contractor, agency, partnership, fiduciary, or similar legal relationship exists only between the relevant Seeker and Giver if they create one, and not with Emploi.
4. Account Registration
4.1 Account creation. To use most features you must create an account by providing a valid email address. Identity is verified via a one-time password ("OTP") sent to that email. There is no user-chosen password.
4.2 Accurate information. You agree to provide accurate, current, and complete information during registration and to keep it up to date. You may not impersonate another person, use a false identity, or create an account for someone else.
4.3 Roles. An account may hold one or both roles (Seeker and Giver). The active role can be switched in-app at any time.
4.4 One account per person. You may not create multiple accounts to evade suspension, inflate ratings, defeat identity verification, or abuse referral mechanisms (where such mechanisms exist).
4.5 Account security. Because login is by email OTP, whoever controls your email inbox controls your Emploi account. You are responsible for maintaining the security of that inbox and for all activity under your account. Notify us immediately at security@emploi-swipejobs.com if you suspect unauthorised access.
4.6 Device access. When you remain signed in on a device, that device retains a session token in device storage. Sign out on shared or lost devices.
4.7 Your name. The name on your profile is used for identity verification (Section 9). Changing it after a successful KYC Check will automatically remove your ID-verified mark, as described in Section 9.5.
5. Acceptable Use
5.1 You agree not to, directly or indirectly:
- (a) post Content that is unlawful, defamatory, obscene, pornographic, hateful, harassing, threatening, or violent;
- (b) post jobs involving illegal work, unlicensed regulated activity, hazardous labour without proper safety, child labour, forced labour, human trafficking, sex work, or any activity prohibited by Indian law;
- (c) discriminate against users on the basis of caste, religion, race, sex, gender identity, sexual orientation, disability, or any other protected ground;
- (d) impersonate any person, misrepresent your affiliation with any organisation, or forge headers or identifiers;
- (e) harvest, scrape, or otherwise extract data from the Platform by automated means; reverse engineer, decompile, or attempt to derive the source code of the Platform, except to the extent such restriction is prohibited by applicable law;
- (f) interfere with, disrupt, or probe the Platform, its security, its rate limits, its row-level security policies, or any infrastructure on which it runs; attempt to gain unauthorised access to any account, system, or data;
- (g) transmit viruses, worms, ransomware, or other malicious code;
- (h) use the Platform to distribute unsolicited advertising, spam, chain letters, pyramid schemes, multi-level marketing pitches, or non-job promotional content;
- (i) circumvent Platform safety mechanisms; solicit users to transact off-Platform to avoid ratings or moderation (note: payment is off-Platform by design, but initial match and communication must occur through the Platform until a Match is formed);
- (j) post Content you do not own or have the legal right to post, including photos of others without consent;
- (k) collect or store personal data of other users except to the extent necessary to engage in a legitimate Job Arrangement;
- (l) use the Platform in any way that violates any applicable law, regulation, or third-party right.
5.2 Verification integrity — zero tolerance. In addition to the above, you must not:
- (a) attempt to defeat, spoof, or replay the Liveness Check using a photograph, printed image, screen replay, video, mask, deepfake, or any other artefact in place of your own live face;
- (b) submit, scan, or present an Aadhaar card, Aadhaar Secure QR, or any other identity document that does not belong to you;
- (c) submit a forged, tampered, or synthetically generated identity document or QR payload;
- (d) set your profile name to another person's name in order to obtain a KYC match against their document;
- (e) sell, rent, share, or transfer a verified account to another person, or operate an account on behalf of an undisclosed third party.
Any breach of Section 5.2 is grounds for immediate and permanent termination without notice, forfeiture of all Verified Badges, and referral to law enforcement. Misuse of another person's Aadhaar may constitute an offence under the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 and the Bharatiya Nyaya Sanhita, 2023.
5.3 Background screening and safety. Users are strongly encouraged to conduct independent verification of counterparties before entering a Job Arrangement, regardless of any Verified Badge. Meet in public or safe locations where appropriate. Emploi is not responsible for the offline conduct of any user.
5.4 Reporting. You may report Content or users that violate these Terms via the in-app report function or by emailing support@emploi-swipejobs.com.
5.5 Consequences. We may, at our sole discretion and without liability:
- remove or restrict Content;
- limit, suspend (time-bound), or permanently terminate accounts;
- revoke or withhold a Verified Badge;
- refuse service;
- withhold cooperation pending investigation;
- report suspected unlawful activity to law enforcement.
6. Job Postings (Givers)
6.1 Your responsibility. As a Giver, you are solely responsible for the accuracy, completeness, and legality of every job you post, including title, description, category, pay rate, payment type, location, required skills, and any uploaded images.
6.2 Prohibited postings. You must not post jobs that require or facilitate activities prohibited under Section 5.1(b).
6.3 Compliance. You are responsible for your own compliance with applicable labour law, minimum wage law, payment of statutory dues (EPF, ESI, professional tax, GST where applicable), worker safety, and tax reporting in respect of any Job Arrangement.
6.4 Editing and deletion. Jobs may be edited or deleted from "My Jobs". A deleted job is removed from Seeker visibility and disappears from Seekers' saved lists and applications immediately.
6.5 Invitations. Givers may invite specific Seekers to a job. Invitations are notifications, not contracts; the Seeker is free to accept, decline, or ignore. Invitations may expire automatically.
6.6 Hiring decisions and worker conduct. As a Giver, you are solely responsible for deciding whether to hire or engage any Seeker, verifying that Seeker's suitability, agreeing the work and payment terms, supervising any work, providing a safe and lawful work environment, and paying all agreed amounts. Emploi is not responsible for any Seeker's behaviour, skill, attendance, work quality, misconduct, negligence, theft, damage, injury, legal status, or failure to perform.
6.7 Location of a job. When you post a job you supply a location which is stored as a geographic point and used to compute distance to Seekers. Do not post a residential location you are not willing to disclose to applicants.
7. Applications (Seekers)
7.1 As a Seeker, you are solely responsible for the accuracy of your profile (name, headline, bio, bio link, skills, work photos, phone number, and work locations).
7.2 By applying to a job, you represent that you are genuinely willing and able to perform the work. Repeated withdrawals or no-shows may adversely affect your rating and visibility.
7.3 You may withdraw an application before a Match is formed. After a Match, you must coordinate any withdrawal with the Giver directly and in good faith.
7.4 Your choice of work. As a Seeker, you are solely responsible for deciding whether to apply for, accept, reject, continue, or stop any work; confirming the Giver's identity and reliability; confirming the work scope, location, timing, payment amount, payment method, safety conditions, and legal requirements; and collecting payment directly from the Giver. Emploi is not responsible for any Giver's behaviour, non-payment, underpayment, cancellation, unsafe conditions, unlawful request, misrepresentation, harassment, injury, or other dispute.
8. Matching, Messaging, and Contact
8.1 Swiping and matching. Seeker discovery uses a swipe mechanic. A right swipe or heart tap expresses interest and saves the job; a left swipe or cross dismisses it. A Giver may discover Seekers through candidate browse features. Swipe history is stored and used to avoid showing you the same card repeatedly.
8.2 In-app messaging. Once a relevant application thread exists, Seekers and Givers may chat in-app. You agree that:
- messages are stored on our servers and are not end-to-end encrypted;
- messages are retained for the duration of the account and for a period after deletion (see the Privacy Policy for retention periods);
- messages may be reviewed by authorised Emploi personnel only where necessary for safety, dispute resolution, abuse investigation, or legal compliance;
- messages may be disclosed pursuant to lawful requests.
8.3 Phone disclosure. A Giver may receive a Seeker's phone number after a genuine hiring intent is established. The disclosure is gated by a server-side role check at the database layer; phone numbers are not broadcast to all users and are not shown in the public discovery feed.
8.4 Notifications. The Platform sends push notifications (new applications, messages, invitations, hiring decisions) and transactional emails (login OTP, welcome, account and security notices). Push notifications can be switched off at the operating-system level; transactional emails required to operate the account cannot be switched off while the account exists.
8.5 Off-Platform communication. Once a Match is formed, you may exchange off-Platform contact details at your own risk. Emploi cannot moderate off-Platform communication.
8.6 User disputes. Emploi may, at its discretion, provide reporting tools, safety tools, or support channels, but Emploi does not arbitrate, guarantee, insure, enforce, or become responsible for any Job Arrangement, payment, workplace issue, user behaviour, or legal claim between users.
9. Identity Verification (Liveness and Aadhaar KYC)
9.1 Voluntary and free. Identity verification is optional and provided at no charge. You may use the Platform without it, though some Givers may prefer verified Seekers. Where a verification requirement is switched on for a category of users, you will be told before you are asked to verify.
9.2 Liveness Check. The App asks you to grant camera permission and complete a short front-camera challenge (for example, blinking or turning your head). Your face is analysed on your device to confirm a live person is present, and the resulting selfie is uploaded to a private storage area that is not readable by other users. If you have a profile photo, the App also compares the selfie to it on-device; if you have no profile photo, or the existing photo contains no detectable face, the App may adopt the selfie as your profile photo, in which case it becomes publicly visible like any other profile photo.
9.3 KYC Check (Aadhaar Secure QR). Where enabled, you may scan the Secure QR code printed on your Aadhaar card or e-Aadhaar. Processing happens entirely on your device:
- the digital signature on the QR payload is verified against UIDAI public certificates bundled with the App;
- the name on the document is compared with the name on your Emploi profile;
- the low-resolution portrait in the QR payload is compared with your liveness selfie. This face comparison is advisory only — it is recorded but never determines the outcome, because the portrait resolution is too low to be conclusive;
- only the last four digits of the Aadhaar number are retained. The full 12-digit Aadhaar number is not present in a Secure QR payload at all, is never transmitted to us, and is never stored;
- we do not connect to UIDAI, do not perform Aadhaar authentication or e-KYC through UIDAI, and are not an Authentication User Agency, KYC User Agency, or requesting entity under the Aadhaar Act.
9.4 Two distinct badges. A "verified" mark on the Platform means one of two different things, and they must not be confused:

9.5 Changing your name removes the ID-verified badge. Because the KYC decision is bound to the name on your document, changing your profile name automatically clears your ID-verified status. Your liveness verification is unaffected. You may re-run the KYC Check at any time. Correcting capitalisation or trailing spaces does not count as a name change.
9.6 Outcomes are automated and final; there is no manual review. Verification is decided on your device. There is no human reviewer, no appeal queue, and no manual override. Possible outcomes:
- Verified — signature valid and name conclusively matched;
- Retry — the scan or selfie was unusable (no QR detected, unreadable image); you simply try again. Nothing is recorded;
- Name confirmation needed — the document is genuine but the name is close rather than conclusive. You are shown the document name and asked to correct your own profile name, then scan again. The App never renames you;
- Liveness only — a failure on our side (no currently valid UIDAI certificate available, an unsupported pre-2018 card format, or an engine error). You keep the liveness badge you genuinely earned and may add the ID badge later;
- Rejected — an invalid signature or a clearly different name. In this case no record of the attempt is created at all.
9.7 Fair-use limits. We may rate-limit verification attempts, and may refuse verification where we detect abuse under Section 5.2.
9.8 No warranty of verification. On-device face and document analysis is probabilistic. It may produce false accepts and false rejects. Emploi does not warrant that any Verified Badge is accurate, current, or sufficient for your purposes, and you must not treat a badge as a substitute for your own due diligence.
9.9 Aadhaar-related data handling is described in Section 2.3 of the Privacy Policy. Consent to verification may be withdrawn by not using the feature and by requesting deletion of your verification records.
10. Location
10.1 The Platform's core function — showing jobs and candidates near you — depends on location. With your operating-system permission, the App reads your device location while in use and stores it as a geographic point on your profile so that distances can be computed on the server. Seekers may additionally save named work areas.
10.2 If you decline location permission, the App falls back to a default city-level location so that it remains usable, and results will not reflect where you actually are.
10.3 Other users are shown an approximate distance to you, not your coordinates or address. A job's stated location is shown as you entered it.
10.4 Map features are provided using Google Maps and are subject to Google's own terms.
11. Ratings and Reviews
11.1 After a Job Arrangement, users may rate and review each other. Reviews must be honest, based on genuine experience, and must not contain personal attacks, discriminatory language, or false statements.
11.2 We may remove reviews that violate these Terms. We do not arbitrate review disputes; however, egregious manipulation (fake reviews, coordinated attacks) is grounds for account termination.
11.3 Your aggregate rating is computed server-side and is visible to other users. Do not offer or solicit inducements in exchange for favourable reviews.
12. User Content Licence
12.1 You retain all ownership and intellectual property rights in Content you submit.
12.2 By submitting Content, you grant Emploi a non-exclusive, worldwide, royalty-free, sublicensable licence to host, store, reproduce, adapt (for technical purposes such as resizing, cropping, re-encoding, and on-device translation), publish, transmit, and display the Content for the purposes of:
- (a) operating, providing, and improving the Platform;
- (b) enforcing these Terms;
- (c) complying with legal obligations.
12.3 Verification media is excluded from this licence. Liveness selfies and any identity-document data are used solely to run and evidence the verification described in Section 9. They are never displayed to other users, never used for marketing, and never used to train machine-learning models. The one exception is where you have no usable profile photo and the App adopts your selfie as your profile photo (Section 9.2) — from that point the adopted photo is treated as ordinary profile Content.
12.4 This licence ends when the Content is deleted by you or by us, except:
- (a) to the extent the Content has been shared with other users (who may retain it in their message history or cached state);
- (b) to the extent retention is required for legal, regulatory, safety, or dispute-resolution purposes as set out in the Privacy Policy.
12.5 You represent and warrant that you own or have all necessary rights to submit the Content and to grant the licence above, and that the Content does not infringe any third-party right.
13. Intellectual Property
13.1 All intellectual property in the Platform itself — including the "Emploi" name, logo, app icons, designs, source code, databases, and documentation — is owned by NilesoftAI or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Platform for its intended purposes, subject to these Terms.
13.2 Nothing in these Terms transfers any intellectual property right from Emploi to you.
13.3 The Platform incorporates third-party and open-source components, which remain the property of their respective owners and are used under their own licences.
13.4 If you believe Content on the Platform infringes your copyright, send a takedown notice to legal@emploi-swipejobs.com with (a) identification of the copyrighted work, (b) the URL or in-app location of the allegedly infringing Content, (c) your contact details, (d) a statement of good-faith belief, and (e) your signature (electronic signatures accepted).
14. Fees
14.1 The Platform is currently provided free of charge to both Seekers and Givers. Identity verification is also free. Emploi reserves the right to introduce fees, subscriptions, or premium features in the future with reasonable prior notice.
14.2 Any fees introduced will be subject to separate published pricing terms. Continued use after a fee change constitutes acceptance.
14.3 You are responsible for your own mobile data, device, and connectivity costs.
15. Third-Party Services
15.1 The Platform relies on third-party service providers including, but not limited to:
- Supabase Inc. — database, authentication, storage, realtime messaging, and edge functions, hosted on AWS;
- Resend Inc. — transactional email delivery;
- Expo (EAS) / Google (Firebase Cloud Messaging) / Apple (Apple Push Notification service) — push notification delivery and app build distribution;
- Google LLC (Maps SDK and Maps APIs) — map display and place lookup;
- Google LLC (ML Kit) — on-device translation, face detection, and barcode scanning. These run entirely on your device; no Content is transmitted to Google for these functions;
- Microsoft Corporation (Clarity) — product analytics, where enabled in a given build;
- Google Play / Apple App Store — app distribution.
15.2 UIDAI public certificates are bundled with the App solely to validate Aadhaar Secure QR signatures offline. This does not make UIDAI a service provider to Emploi, and Emploi is not affiliated with, endorsed by, or acting on behalf of UIDAI or the Government of India.
15.3 Your use of the Platform may involve data processing by these providers. Refer to the Privacy Policy for full details and to each provider's own terms for their direct obligations to you.
15.4 We are not responsible for the acts or omissions of third-party providers, except to the extent required by applicable law.
16. Availability and Changes to the Platform
16.1 We may add, change, suspend, or discontinue any feature of the Platform at any time, including identity verification, without liability.
16.2 The App is distributed through app stores and may require updating. We do not warrant that older installed versions will continue to function. Some server-side changes intentionally prevent outdated app versions from performing certain actions.
17. Warranties and Disclaimers
17.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment.
17.2 Emploi does not warrant that:
- (a) jobs posted are genuine, lawful, safe, or paid;
- (b) users' profiles, skills, ratings, or identities are accurate;
- (c) any Verified Badge is accurate, conclusive, or free from false accepts or false rejects;
- (d) the Platform will be uninterrupted, timely, secure, or error-free;
- (e) defects will be corrected;
- (f) the Platform is free of viruses or harmful components;
- (g) location results, distances, or map data are accurate;
- (h) on-device translations are accurate — translations are provided for convenience and the original text prevails;
- (i) any particular match, hire, income, or commercial result will occur.
17.3 You assume all risk arising from (i) interacting with, meeting, working for, or hiring any other user, and (ii) entering into any Job Arrangement.
17.4 Any decision to offer work, accept work, hire, engage, pay, meet, travel, share contact details, or continue communicating with another user is made by you independently and at your own risk.
18. Limitation of Liability
18.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Emploi, NilesoftAI, and their affiliates, directors, officers, employees, and agents shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including without limitation lost income, lost wages, lost opportunity, physical harm, property damage, emotional distress, or reputational harm, arising from:
- (a) your use of or inability to use the Platform;
- (b) any Job Arrangement, payment, non-payment, hiring decision, work performance, workplace condition, user conduct, or interaction with any other user;
- (c) any Content posted by any user;
- (d) reliance on any Verified Badge, or the grant, refusal, or revocation of one;
- (e) any unauthorised access to or alteration of your data;
- (f) any act or omission of any third-party service provider;
- (g) any downtime, loss of data, or failure of the Platform.
18.2 Emploi's aggregate liability to you for all claims in any twelve-month period shall not exceed the greater of (i) INR 1,000 or (ii) the amount you paid to Emploi during that period.
18.3 Nothing in this section excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence, fraud, or wilful misconduct.
19. Indemnity
19.1 You agree to indemnify, defend, and hold harmless Emploi, NilesoftAI, and their affiliates, directors, officers, employees, and agents from and against any claim, demand, loss, liability, damage, or expense (including reasonable legal fees) arising out of or related to:
- (a) your breach of these Terms;
- (b) your Content;
- (c) your use or misuse of the Platform;
- (d) your interaction with or conduct toward any other user;
- (e) any Job Arrangement;
- (f) any identity document you submit, including one that is not yours;
- (g) your violation of any law or third-party right.
20. Suspension and Termination
20.1 By you. You may close your account and request erasure of your personal data at any time by following the process at emploi-swipejobs.com/deletion. Signing out of the App does not delete your account or your data.
20.2 By us. We may suspend or terminate your account or restrict access to the Platform at any time, with or without notice, if:
- (a) you breach these Terms;
- (b) your conduct creates risk or legal exposure for Emploi or other users;
- (c) we are required to do so by law or by order of a competent authority;
- (d) the Platform is discontinued;
- (e) your account is inactive for an extended period.
20.3 Effect. On termination, your right to use the Platform ends immediately. Sections 12, 13, 17, 18, 19, 21, 22, and 23 survive termination.
20.4 Data. Deletion and retention of your data post-termination are governed by the Privacy Policy.
21. Changes to these Terms
21.1 We may update these Terms from time to time. Material changes increment the version number recorded in our system, together with a cryptographic hash of the exact document text. On your next sign-in after a material change, you will be required to review and accept the updated Terms before continuing to use the Platform.

22. Governing Law, Jurisdiction, and Dispute Resolution

24.8 Language. These Terms are drafted in English. The App is available in English, Hindi, Telugu, Tamil, Kannada, Malayalam, Marathi, and Bengali; any translation of these Terms is for convenience only and the English version prevails in case of conflict.
